Terms and Rules
Welcome to ClubSailing.
Use of the platform implies full acceptance of these terms.
1. Scope of the service
ClubSailing is a web platform dedicated to managing and organising regatta and cruising activities for yacht clubs, crews, events and internal communications between registered users.
Access to and use of the service is permitted only in compliance with these terms.
2. Platform access
Users are responsible for the accuracy of data entered during registration and for safeguarding their login credentials.
The following is strictly prohibited:
- Using the platform for unlawful purposes;
- Posting offensive, defamatory or unlawful content;
- Attempting to compromise system security or operation;
- Sharing login credentials with unauthorised parties.
The company reserves the right to suspend or deactivate accounts that breach these terms.
3. Technical support
Technical support is available 5 days a week, Monday to Friday, during office hours only.
Support is not guaranteed on public holidays, bridge days or outside the stated hours. Additional services may be requested for specific events.
Support requests are handled through the dedicated ticket system, with a prompt response during working hours.
4. Data responsibility
The platform owner is not responsible for data processed, uploaded, shared or managed by users within the application.
Each user or organisation using ClubSailing is directly responsible for:
- The lawfulness of data entered;
- Compliance with applicable privacy and data protection laws (GDPR);
- Obtaining any required consents;
- Managing and storing processed information.
The company does not pre-screen user content and accepts no liability for improper use of the platform.
5. Limitation of liability
The platform is provided “as is”. The company does not guarantee complete absence of interruptions, technical errors or temporary malfunctions.
The system is hosted with an Italian primary provider with a guaranteed uptime of 99.9%.
Under no circumstances shall the company be liable for:
- Loss of data;
- Direct or indirect damage arising from use of the service;
- Operational interruptions;
- Improper use of the platform by users.
6. Fees, renewal and cancellation
The annual subscription fee is €199.00 per year (VAT included).
Important: If renewal is not completed by the annual expiry date, the contract shall be deemed terminated, the service will be permanently discontinued and related data will be removed from our servers, resulting in total loss of service history.
Users may cancel at any time. To exercise the right of cancellation, send a written email to info@39app.it, stating:
- The account username;
- The yacht club / organisation name.
Cancellation is complete only after official confirmation from our technical department.
7. Changes to these terms
The company may amend these terms at any time. Changes will be published on the website and take effect immediately upon publication.
